1. Provider and acceptance
Get Online for $99 is a service operated by Mad Town Enterprises LLC of Hanover, Indiana (“we,” “us,” or “our”). By paying an invoice, approving a proposal, or using the service, the customer (“you”) agrees to these Terms of Service and the applicable written proposal or invoice.
2. Included service
Unless a written proposal says otherwise, the $99 annual plan includes one custom one-page informational website, reasonable copywriting based on information you provide, responsive mobile design, hosting, SSL, basic on-page search setup, one contact button or simple contact form, one organized revision round, launch assistance, and one eligible standard domain registration.
The plan does not include ecommerce, checkout, customer accounts, custom applications, multi-page sites, a new logo, business email, ongoing edits, paid advertising, premium domains, or paid third-party services. Optional work is quoted separately and begins only after your approval.
3. Eligibility and project approval
Submitting the intake form does not create a contract or guarantee acceptance. We may decline projects that exceed the plan, involve prohibited or unlawful activity, create an unreasonable technical or legal risk, or are otherwise not a good fit. We confirm scope, timing, and price before requesting payment.
4. Payment and refunds
Payment is due before work is scheduled unless we agree otherwise in writing. Because the service includes reserved production time and custom work, payments become nonrefundable once design or copywriting begins. If we cancel before delivering a usable draft for reasons unrelated to your breach, we will refund the amount paid for the undelivered service. Approved third-party purchases, domain fees, and completed custom work are nonrefundable.
5. Customer responsibilities
You must provide accurate business information, timely feedback, usable images, and any legally required licenses, disclosures, policies, or industry statements. You represent that you have permission to use all names, logos, text, photographs, trademarks, and other materials you provide. You are responsible for reviewing the final website for factual accuracy, spelling, prices, claims, legal compliance, and contact details before approval.
6. Schedule and delays
Most qualifying projects are targeted for launch within 7–14 business days after payment and receipt of complete materials. This is an estimate, not a guaranteed deadline. Customer delays, expanded scope, registrar restrictions, third-party outages, and circumstances beyond our reasonable control extend the schedule. A project may be placed on hold if requested materials or approval are not received within 30 days.
7. Revisions and approval
One revision round means one consolidated list of reasonable changes to the initial draft. Minor copy corrections, image substitutions, color adjustments, and modest layout refinements generally qualify. A new creative direction, added sections, repeated change requests, new functionality, or changes after approval may require an additional quote. Written approval authorizes launch.
8. Ownership, license, and portfolio use
You retain any rights you already hold in original materials you provide to us. Mad Town Enterprises LLC retains ownership of the website design, assembled website files, copy we create, reusable code, methods, systems, templates, tools, and preexisting materials. While your annual plan is paid and current, we grant you a limited, nonexclusive, nontransferable license to use the completed website for the business identified in the project. Third-party fonts, images, software, and services remain subject to their own licenses.
Unless you ask us in writing not to, we may identify the finished public website in our portfolio and marketing as an example of our work. We will not publish confidential information supplied only for project administration.
9. Domains
If you bring an existing domain, you retain ownership and control of that domain and authorize us to connect it to the website. You remain responsible for its registration, renewal, account security, and registrar charges.
If a domain is registered by us as part of the $99 plan, Mad Town Enterprises LLC owns and controls that domain registration. It remains connected to the website while the annual plan is paid and current. An included domain is not transferred automatically upon cancellation or expiration. Any requested sale or transfer is solely at our discretion, requires all invoices to be paid, remains subject to registrar and ICANN restrictions, and may require a separate written agreement and fee.
10. Hosting, renewal, and cancellation
The plan covers hosting and included services for one year from the service start date shown on the invoice or launch notice. It renews annually at $99 unless a written proposal states another price or we give advance notice of a future price change. We may send renewal reminders, but you remain responsible for timely payment.
You may cancel by emailing us before renewal. Cancellation stops future renewal; it does not create a refund for the current term. If renewal is not paid, we may suspend the site and allow hosting or domain registration to expire. We may retain a backup for a limited time but do not guarantee recovery after suspension or expiration.
11. Updates, security, and third-party services
Ongoing content edits are not included unless quoted. We use reasonable measures to host and secure the website, but no internet service is guaranteed to be uninterrupted, error-free, or immune from attack. Forms, registrars, hosting infrastructure, analytics, maps, fonts, and other features may rely on third parties. Their availability and policies are outside our control.
12. Prohibited use
You may not use the service for unlawful activity, fraud, infringement, malware, unsolicited bulk messaging, harassment, or content that violates another person’s rights. We may suspend or terminate a site when reasonably necessary to protect users, systems, third parties, or our business.
13. Disclaimer and limitation of liability
Except for promises expressly stated in writing, the service is provided “as is.” We do not guarantee search-engine rankings, traffic, leads, sales, uptime, or business results. To the fullest extent permitted by law, Mad Town Enterprises LLC is not liable for indirect, incidental, special, consequential, or lost-profit damages. Our total liability arising from the service will not exceed the amount you paid us for the affected annual term.
14. Governing law and disputes
These terms are governed by Indiana law, without regard to conflict-of-law rules. Before filing a claim, both parties agree to make a good-faith effort to resolve the dispute informally. Any court proceeding must be brought in a court with jurisdiction in or serving Jefferson County, Indiana, unless applicable law requires otherwise.
